This is the privacy and cookies policy for 88 Acres Foods, Inc. (we, us and our) in connection with our website and related software applications (collectively, the “Website”). For the purposes of the Data Protection Act 1998 and similar acts, we are the data controller.

We are committed to protecting your privacy on-line. We appreciate that you do not want the personal information you provide to us distributed indiscriminately and here we explain how we collect information, what we do with it and what controls you have.

By using the Website, you consent to the collection and use of information in accordance with this privacy policy.

Information we may collect from you

We may collect and process the following information about you:

  • information (such as your name, email address, postal address, billing address, telephone number, payment information, occupation, how you heard of us) that you provide by purchasing our products on the Website or completing forms, including if you register as a user of the Website, upload or submit any material via the Website, request any information, or enter into any competition or promotion we may sponsor;

We place great importance on the security of all personally identifiable information associated with our users.  We have security measures in place to attempt to protect against the loss, misuse and alteration of personal information under our control.  For example, our security and privacy policies are periodically reviewed and enhanced as necessary and only authorised personnel have access to personal information.  Whilst we cannot ensure or guarantee that loss, misuse or alteration of information will never occur, we use all reasonable efforts to prevent it.

You should bear in mind that submission of information over the internet is never entirely secure.  We cannot guarantee the security of information you submit via the Website whilst it is in transit over the internet and any such submission is at your own risk.

It is advisable to close your browser when you have finished your user session to help ensure others do not access your personal information if you use a shared computer or a computer in a public place.

Storage of your information

Information that you submit via the Website is sent to and stored on secure servers managed by Shopify located in the United States and Canada.  Shopify is certified Level 1 PCI DSS compliant and this extends to all online stores it hosts. Shopify performs regular assessments and continuous risk management to ensure its ecommerce software hosting is secure. This is necessary in order to process the information.  Information submitted by you may be transferred by us to our other offices and/or to the third parties mentioned in the circumstances described above (see Information sharing), which may be situated outside the United States.

Your rights

You have a legal right under the Data Protection Act 1998 to a copy of all the personal information about you held by us.  On request, we will provide you with a copy of this information subject to a fee not exceeding $20.00.  You also have a right to correct any errors in that information.  As mentioned above, you have a right to prevent the use of your personal information for direct marketing purposes.

SERVICE PROVIDER ADDENDUM

This Service Provider Addendum (“Addendum”) sets forth the terms and conditions relating to compliance with the California Consumer Privacy Act of 2018, Cal. Civil Code § 1798.100 et seq., (together with its implementing regulations and as amended from time to time, the “CCPA”) in connection with the services being rendered by Vendor, LLC (“Vendor”) to Client effective as of the Effective Date of the Software as a Service and Master Hosting Agreement (the “Agreement”) to which this Exhibit E is attached.

Any capitalized term used but not defined herein shall have the meaning ascribed to it in the CCPA.

 

  1. Personal Information

1.1 “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, that may be Processed by Vendor pursuant to the performance of the Agreement. Personal Information includes, but is not limited to, the data elements listed in section 140(o)(1)(A)-(K) of the CCPA, if any such data element identifies, relates to, describes, is capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular individual or household.

1.2 For purposes of clarity, Personal Information does not include aggregated and/or de-identified information

 

  1. Privacy of Personal Information

2.1. Client is a Business subject to the CCPA.

2.2. Vendor (i) is a Service Provider that provides services to Client pursuant to the Agreement and (ii) Processes, on behalf of Client, Personal Information that is necessary to perform the services under the Agreement.

2.3 To comply with the CCPA, Vendor represents, warrants and covenants as follows:

(a) The Personal Information that Client discloses to Vendor is provided to Vendor for a Business Purpose (including, without limitation, performing services on behalf of Client);

(b) Vendor is acting solely as a Service Provider with respect to Personal Information; and

(c) Vendor shall not (1) Sell Personal Information, or (2) retain, use or disclose Personal Information (i) for any purpose other than for the specific purpose of performing the services, or (ii) outside of the direct business relationship between Client and Vendor.
